Facts

Christine Schroeder (plaintiff) was flying from Chicago to Frankfurt with Lufthansa German Airlines (Lufthansa) (defendant). After the flight departed, a classmate of Schroeder called the Chicago Air Traffic Control center and said that Schroeder had unknowingly brought a bomb on the plane. Air Traffic informed the pilot of Schroeder’s flight, and the plane made an emergency landing in Canada. Before landing, the pilot told a flight attendant to page Schroeder and accompany her to the cockpit. When Schroeder arrived at the cockpit, the pilot told her about the phone call and asked if she knew anything about it. The pilot then asked Schroeder to stay in the cockpit, and she agreed. The flight engineer fastened seatbelts for Schroeder, and she never expressed that she wanted to leave. Once the plane landed, Schroeder was detained and questioned and ultimately able to reboard the flight and continue her travel to Germany. Schroeder brought suit against Lufthansa for false arrest and false imprisonment. The United States District Court for the Northern District of Illinois granted Lufthansa’s motion for summary judgment and dismissed Schroeder’s case. Schroeder appealed.
