Facts
Ralph Herrmann (defendant) wrote a check for $10,000, payable to a casino in Nevada, in exchange for gambling chips at the casino. The casino assigned the debt evidenced by the check to Sea Air Support, Inc. (Sea Air) (plaintiff), in exchange for Sea Air’s promise to take whatever legal action was necessary to enforce collection on the check. Sea Air sued Herrmann in Nevada to collect on the check. The district court dismissed the action, holding that Sea Air’s claim was barred under the common-law prohibition against actions to collect gambling debts. Sea Air appealed.
