J. Scott Seawright (plaintiff) consistently lied to and deceived his employer, Charter Furniture Rental, Inc. (Charter) (defendant), to conceal his association with a man from whom Seawright could contract the Autoimmune Deficiency Syndrome (AIDS). As a result of those lies and deceptions, Charter had no knowledge of Seawright's association and no reason to think he could contract AIDS. Charter fired Seawright for poor performance, but Seawright speculated that Charter knew that Seawright might contract AIDS and fired him for that reason. Based only on those speculations, Seawright sued Charter for violating the Americans with Disabilities Act of 1990 (ADA). Before filing the suit, Seawright's attorney Janette Johnson interviewed Seawright, who told Johnson of his speculations. Johnson never contacted Charter or reviewed Charter's records, even though she knew that Charter explained Seawright's discharge as having been based solely on its records of Seawright's poor performance. After the court granted Charter's motion for summary judgment, Charter moved to recover its attorney's fees from Seawright and Johnson.
