Facts
Mr. and Mrs. Caranas (plaintiffs) were guests at the Shamrock Hilton Hotel (hotel) (defendant) on September 4, 1966. After eating at the hotel restaurant, Mrs. Caranas accidentally left behind her purse, which contained over $13,000 of jewelry. The purse was found by a hotel busboy, who, following hotel protocols, gave the purse to the restaurant cashier. The cashier then delivered the purse to someone other than the Caranas who came to claim the purse. The Caranas filed a suit, alleging negligent delivery of the purse. The trial court held in favor of the Caranas. The hotel appealed.
