Facts

In May 1999, the Pennsylvania Turnpike Commission (the commission) (defendant) engaged in mediation with Roger Haas regarding a grievance concerning a method of calculating overtime compensation. Haas was a member of the International Brotherhood of Teamsters, Local 30 (Local 30), and mediation was a third step of the union’s grievance procedure. During the Haas mediation, the commission made a statement against its interest to the effect that the commission had faced and settled other lawsuits regarding the method of calculating compensation due to the method’s illegality. In October 1999, a group of commission employees (the union members) (plaintiffs), who were Local 30 members, sued the commission based on the overtime-compensation methodology. The union members sought to depose the commission on the topic of the Haas mediation. The union members argued that the commission’s admission made during the Haas mediation was highly relevant to their claims and defenses. The commission responded by filing a motion for a protective order that would preclude any discovery of mediation communications and documents. The commission argued that a federal mediation privilege should be recognized.
