Facts
Mona Sloop (plaintiff) executed a sale contract for a parcel of real estate with Sally and Russell Kiker (defendants). Sloop made a down payment of $350,000. The sale contract did not contain a sufficient description of the property. However, Sloop and the Kikers executed a warranty deed the same day as the sale contract, which provided a formal, legal description of the property in the form of a street address and included the Kiker trust as the seller. Later, Sloop sued the Kikers, seeking to void the sale contract under the Arkansas Statute of Frauds because the Kiker trust was not properly listed as the seller in the sale contract and the property was not sufficiently described. The trial court entered summary judgment in favor of the Kikers. Sloop appealed.
