Facts
Stephen Sotelo (plaintiff) accused DirectRevenue (defendant) of deceptively distributing spyware onto thousands of computers. The spyware allowed DirectRevenue to track users’ web browsing behavior and deliver targeted pop-up advertisements to those computers. Sotelo asserted that DirectRevenue’s behavior amounted to a trespass of personal property. Sotelo sought injunctive relief and compensatory damages. DirectRevenue moved to dismiss the trespass claim.
