Southwest Weather Research (Southwest) (defendant) was the owner and operator of planes that utilized a process called “cloud seeding.” This process involved Southwest flying planes that discharged a chemical substance intended to disperse clouds and suppress hail. Joe Rounsaville (plaintiff), unhappy with the planes flying over his property and affecting the weather, brought a trespass suit to enjoin Southwest from continuing its cloud seeding. The trial court granted Rounsaville a temporary injunction. Southwest appealed.
