Star Insurance Co. v. Cedar Valley Express, LLC
United States District Court for the District of Columbia
273 F. Supp. 2d 38 (2002)
- Written by DeAnna Swearingen, LLM
Facts
Star Insurance Co. (Star) (plaintiff) issued a surety bond to Cedar Valley Express, LLC (defendant). According to Star, 35 corporations (defendants) from 13 states asserted claims to the bond, exceeding the bond’s penal sum of $10,000. Star claimed it was unable to determine who was entitled to the bond and feared it would be exposed to multiple lawsuits. Star therefore filed suit in federal court and moved to implead the claimants under the Federal Interpleader Act, 28 U.S.C. § 1335 (the Act). Star also requested a preliminary injunction barring the claimants from filing suits related to the bond in other courts.
