Facts
Jennifer Barno (plaintiff) was a senior at a vocational public high school overseen by the Maplewood JVS Board of Education (board) (defendant). The board had enacted an attendance policy denying academic credit to students with 13 or more absences. Barno successfully completed her school’s curriculum, passing all her state tests and earning a 3.966 out of 4.0 grade point average. Barno had 18.5 absences her senior year, 16.5 of which had been deemed excused. Barno’s principal informed Barno that, because Barno had more than 13 absences, Barno would not graduate. Barno filed a form seeking reconsideration due to extenuating circumstances to a reinstatement committee. Neither the form nor any publication furnished to Barno defined what would constitute extenuating circumstances. The committee declined to find extenuating circumstances, and Barno filed an appeal for reconsideration, which the committee denied. Barno then filed an action in state court seeking judicial review of the board’s decision to deny Barno her high school diploma. The trial court ruled against Barno, and Barno appealed.
