Facts
Hay (defendant) owned a beachside resort and desired to construct fences to keep the public from traveling across the dry-sand area of their beachfront property lying between the high tide line and the upland vegetation line. The State of Oregon (plaintiff) sought an injunctive order prohibiting Hay from obstructing public access to the dry-sand area. The trial court issued the injunction and Hay appealed.
