Facts
Petersen (defendant) and Mike Barlow were driving in Petersen’s pickup truck when they saw Daniel Warren and Richard Wille at a gas station. Wille told Petersen he wanted to race his Chevrolet Nova against Petersen’s truck. In a residential area of town, the two vehicles drag raced and reached speeds in excess of 70 miles per hour in a 35 mile per hour zone. At some point prior to coming to an intersection, Petersen began to decelerate his truck and brought it to a complete stop. Wille passed Petersen without slowing, entered the intersection, and collided with a truck. Wille and Warren were killed. Petersen was charged with manslaughter and two other charges, was convicted by a jury, and he appealed.
