Facts

In the course of two lawful and routine police traffic stops, police asked the motorists’ passengers, James Rankin and Kevin Staab (defendants), for identification. In both cases, the passengers’ compliance with these requests led to their arrests and the seizure of evidence that the State of Washington (plaintiff) used in prosecuting the men. The trial court in Rankin’s case suppressed the evidence and dismissed the case. The state appealed that dismissal. Staab’s case ended in his conviction, which Staab appealed. The appellate court consolidated the appeals, reversed and remanded Rankin’s case for trial, and affirmed Staab’s conviction. Both men appealed to the Washington Supreme Court.
