Facts
Nebraska (plaintiff) charged Mark Vejvoda (defendant) with drunk driving. A judge convicted Vejvoda after a bench trial in Hall County. The sole eyewitness, a Hall County policeman, testified he observed Vejvoda at Seventh and Vine Streets and later apprehended him on Oak Street. The judge took judicial notice that those streets were within the court's jurisdiction. The policeman provided other details from which it could be inferred that the drunk driving occurred in Hall County. Vejvoda's appeal reached the Supreme Court of Nebraska, where Vejvoda challenged the propriety of the judicial notice.
