Facts
Eleanor Staton (plaintiff) filed a class action against Boeing Company (Boeing) (defendant) alleging racial employment discrimination under fee-shifting statutes. The parties reached a proposed settlement that provided (1) $7.3 million to the class, (2) $3.65 million in injunctive relief to avoid future discrimination, and (3) 28 percent of that combined amount, or $4.05 million, to class counsel as attorney’s fees. The parties presented the settlement to the district court to accept or reject in its entirety. The district court approved the settlement. Objecting class members appealed to the Ninth Circuit, arguing that the injunctive relief did not provide much actual benefit and that the attorney-fee award was excessive.
