Facts

The Oakdale Irrigation District (the District) (defendant) owned a tract of land in the watersheds of two flowing streams. The District appropriated water from one of the streams, the Stanislaus River, to irrigate its land. The District carried some of the water into portions of its land within the watershed of the other creek, Lone Tree Creek. Some of the runoff flowed into Lone Tree Creek. For years Stevens (plaintiff) used the runoff from Lone Tree Creek. After more than two decades, the District began to recapture the runoff from Lone Tree Creek for its own reuse. The District diverted water from Lone Tree Creek before the water left the District’s land. Stevens asserted that he was entitled to have the same volume of runoff continue to flow to him.
