George Levasseur was an attorney for Bethlehem Steel Corporation (Bethlehem) (defendant). As part of his job with Bethlehem, Levasseur practiced employment law, focusing on hourly and salaried nonexempt employees. After nine years, Levasseur left Bethlehem and started working at a private law firm. Walter Stitz (plaintiff), an employee at Bethlehem, hired Levasseur to represent him in an age-discrimination case against Bethlehem. Stitz was a salaried exempt employee at Bethlehem. Bethlehem filed a motion to disqualify Levasseur on the ground that he was privy to confidential Bethlehem personnel policies and procedures due to his previous work for the company as a labor attorney. Levasseur argued that his work at Bethlehem involved hourly and salaried nonexempt employees, not a salaried exempt employee like Stitz.
