Facts
One hundred and fifty families (plaintiffs) purchased residences that they later discovered were located near a hazardous-waste dump site. The plaintiffs brought suit against the building developers, John B. Canuso, Sr., John B. Canuso, Jr., Canetic Corporation, and Canuso Management Corporation (defendants). The plaintiffs also brought suit against the developers’ selling agent, the brokerage firm Fox & Lazo Inc. (defendant). The plaintiffs argued the defendants: (1) knew of the existence and the hazards of the dump site, (2) had a duty to disclose this information, and (3) failed to do so.
