Tarrant Regional Water District v. Herrmann

United States Supreme Court
569 U.S. 614 (2013)

Facts

Tarrant Regional Water District (Tarrant) (plaintiff) supplies water to north-central Texas. The Red River Compact (Compact) from Oklahoma governs the allocation of water rights among the states within the Red River basin. In the years following the implementation of the Compact, Tarrant sought a water-resource permit from the Oklahoma Water Resources Board (OWRB) to take water from a tributary of the Red River located in Oklahoma. When Tarrant filed its permit application, it also filed suit against Herrmann (defendant) in federal district court. Tarrant sought to enjoin the enforcement of the Oklahoma water statutes by the OWRB. Tarrant argued that the statutes placed burdens on interstate commerce, were unconstitutional because federal law preempted the statutes, and violated the Commerce Clause by discriminating against interstate commerce in water.
