Facts
Paul Teschner (plaintiff) entered a contest to win an education annuity naming his granddaughter as the beneficiary. The contest rules had an age requirement, and Teschner was not eligible for the prize himself. Teschner’s entry won the prize. The commissioner of internal revenue (defendant) determined that the prize was taxable gross income to Teschner. Teschner petitioned the tax court for a redetermination.
