Facts
The government of Thailand (defendant) enacted a regulation under which all imports of cigarettes required a license. Thailand justified the restriction on public-health grounds, though domestic cigarettes remained readily available. At a point when Thailand hand granted no license for cigarette imports within a decade, the United States (plaintiff) brought a complaint to a World Trade Organization (WTO) dispute-resolution panel. The United States argued that the Thai regulation had been enacted for protectionist purposes in violation of the General Agreement on Tariffs and Trade (GATT), which was incorporated into the WTO.
