The Boeing Company (Boeing) designed and manufactured military and commercial aircraft at various facilities around the United States. Some of Boeing’s work was classified, and Boeing was required to maintain certain security standards as a contractor for the federal government. Boeing was also a target for espionage and attack, both domestically and by foreign governments. Boeing maintained a policy restricting the use of camera-enabled devices such as cell phones on Boeing property (the no-camera rule). In an administrative proceeding, an administrative law judge applied the relevant test promulgated by the National Labor Relations Board (the board) and found that the no-camera rule was unlawful because employees could reasonably construe the rule as a restriction on their protected rights under the National Labor Relations Act. The matter was reviewed by the board.
