Tracey v. Solesky

Maryland Court of Appeals
2012 WL 3759036 (2012)

Facts

Clifford, a pit bull, jumped out of his pen twice in one day and attacked two boys, including Dominic Solesky (plaintiff). Solesky sustained life-threatening injuries, and he brought a negligence claim against Dorothy Tracey (plaintiff), the landlord of the premises where the attack occurred. The trial court granted judgment in favor of Tracey because there was insufficient evidence to support a negligence claim. Solesky appealed to the court of special appeals, which reversed the trial court, finding that there was sufficient evidence to create a question for the jury as to whether Tracey knew that Clifford was dangerous in respect to the then common-law standards in dog-attack negligence cases. Tracey appealed.
