Ali Amirnazmi (defendant), a chemical engineer, marketed a software called ChemPlan to Iranian purchasers. The software was intended to convey pricing and scientific information related to the construction of chemical plants. The United States (plaintiff) charged Amirnazmi with violating the International Emergency Economic Powers Act (IEEPA), which provided the statutory basis for an American embargo on trade with Iran. The embargo included an exemption for informational materials, which Amirnazmi argued applied to the software. However, the embargo also required exempt materials to be fully created and in existence at the time of trade. At trial, the jury found that ChemPlan had not been fully created at the time of the transactions. Amirnazmi was convicted on 10 charges. Amirnazmi appealed. The United States Court of Appeals for the Third Cicrcuit granted certiorari.
