Extreme Associates, Inc. (defendant) was charged with violating federal obscenity law by mailing three pornographic videotapes to a postal inspector in Pittsburgh and delivering six digital videoclips over the Internet to that same undercover inspector. The inspector ordered the videotapes through Extreme’s publicly available website and accessed the videoclips after purchasing a monthly membership to the members-only section of Extreme’s website. At trial, Extreme argued that the court should determine whether the material was obscene by looking at Extreme’s entire website and all webpages to which it linked. Extreme also argued that the material should be judged on a worldwide community standard because the material was available on the Internet and could be accessed from anywhere.
