Facts
Anthony Gandy, his brother, Christopher Gandy, his sister, Sharon Gandy-Micheau, and Sharon’s husband, Durand Micheau (defendants), submitted fake tax returns to the Internal Revenue Service to claim tax refunds for nonexistent excess withholding. The group successfully obtained refunds for many of the returns but were eventually caught by authorities. Each participant was charged with and convicted of several crimes, including mail fraud, conspiracy to commit mail fraud, and aggravated identity theft. During the investigation, police found notebooks in the parties’ possession with the names and personal identifying information of many individuals. Police also found original identification documents for some of the victims and other documents indicating that stolen identities were used in the scheme. Anthony and Sharon appealed their convictions to the Sixth Circuit, arguing that the records contained no evidence that they knew they were using real people’s information in their scheme.
