Facts
Lane Labs—USA Inc. (defendant) sold dietary supplements and skin creams that it claimed were valid cancer and HIV treatments. The government believed the supplements were drugs subject to Food and Drug Administration approval. The government sued for a permanent injunction to stop Lane Labs from selling the products. The government also asked for restitution for consumers who had bought the products. The district court granted the permanent injunction and ordered restitution. Lane Labs appealed, arguing that the Food, Drug, and Cosmetic Act did not give a district court the power to order restitution to consumers.
