The federal Drug Enforcement Administration (DEA) (plaintiff) issued an administrative subpoena to the Michigan Department of Community Health (MDCH) (defendant) as part of an investigation into potential violations of the federal Controlled Substances Act (CSA). The DEA’s subpoena, issued pursuant to the CSA, sought copies of medical-marijuana authorization applications and the resultant medical-marijuana authorization cards for seven individuals authorized as medical-marijuana users or primary caregivers under Michigan’s medical-marijuana law. The MDCH refused to comply with the subpoena, citing a provision in Michigan’s medical-marijuana law prohibiting disclosure of certain confidential information contained in the subpoenaed documents. The DEA filed a lawsuit in federal district court seeking a judicial order enforcing the subpoena and requiring the MDCH to produce the subpoenaed documents.
