Facts
Richard Stadtmauer (defendant) was charged with filing fraudulent tax returns for limited partnerships owned by Charles Kushner. A partner from the outside accounting firm that prepared the returns testified as a lay witness, and an IRS agent testified as an expert witness. After the jury convicted Stadtmauer, he appealed on two grounds. First, he argued that the court improperly allowed the accountant to give opinion testimony by saying Stadtmauer knew about problems in the returns. Second, he argued that the court improperly allowed the IRS agent to opine whether the returns were fraudulent, because that was an ultimate issue for the jury to decide.
