Facts
Charles Stone, Dora Stone, and Byron Woody (defendants) were charged with tax fraud. The prosecution proffered the expert testimony of Ms. Cantrel, a certified public accountant with 18 years of experience as an IRS (Internal Revenue Service) agent who had performed many audits. Ms. Cantrel’s opinion was based on conversations she had with employees of Benton Manufacturing Company during an IRS criminal investigation. Because the employees would not be testifying to these statements, they were hearsay. Charles, Dora, and Byron objected to Ms. Cantrel’s testimony because it was based on inadmissible hearsay.
