Facts
The Food and Drug Administration (FDA) sought a court order to recall furosemide, a human drug, from the marketplace. Superpharm Corporation and its president, Norman E. Rubin, manufactured and distributed furosemide without FDA approval. In support of its request, the FDA argued that federal district courts have authority under § 302 of the Federal Food, Drug, and Cosmetic Act (FDCA) as well as the courts’ general equitable powers to issue the recall order.
