Huping Zhou (defendant) was a research assistant at the University of California at Los Angeles Health System (UHS). After Zhou was fired, he accessed UHS patient records without permission. Zhou was charged with violating the provision of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) that prohibits improperly obtaining individually identifiable health information relating to a person. Specifically, HIPAA provided that a “person who knowingly and in violation of this part . . . obtains individually identifiable health information relating to an individual . . . shall be punished” in accordance with the law. Zhou filed a motion to dismiss, claiming that he was unaware that his conduct was illegal. The district court magistrate denied the motion. Zhou appealed.
