Facts

A physician and a medical administrator formed Utopia Provider Systems, Inc. (Utopia) (plaintiff) to own and manage rights in ED Maximus, a set of template medical charts for use in physician-patient encounters. The template included headings for various pieces of vital information, including questions doctors should ask about medical history and present symptoms. Pro-Med Clinical Systems, LLC (Pro-Med) (defendant) copied the ED Maximus templates for its own medical forms, which it called Pro-Med Maximus. Utopia brought suit against Pro-Med for copyright infringement in federal district court. The court held that the ED Maximus templates were not copyrightable, and the court granted summary judgment in favor of Pro-Med. Utopia appealed. The United States Court of Appeals for the Eleventh Circuit granted certiorari.
