Central Hudson Test
Definition
A test to determine when restrictions on commercial speech violate the First Amendment of the Constitution set forth in Central Hudson Gas & Electric Corp. v. Public Service Commission, 447 U.S. 557 (1980). The test considers whether (1) the speech advertises illegal activities or constitutes false advertising, (2) a substantial government interest justifies the restriction, (3) the law advances the government's interest, and (4) the regulation of speech is narrowly tailored to achieve that interest.
