Fraud in the Factum
Definition
Fraud in which the deceit causes a person to misunderstand a fact. In contract law, fraud in the factum occurs if one party deceives another party about the contents of the agreement being signed. In criminal law, fraud in the factum can occur if a perpetrator deceives a victim about whether intercourse is actually occurring (e.g., a doctor having intercourse with a patient while tricking the patient into thinking the act is a medical procedure).
