Uniform Commercial Code § 1-201(b)(10)

Definition

Provision of the Uniform Commercial Code that defines a “conspicuous” term as one that was written, displayed, or presented in a way such that a reasonable person should have noticed it. Conspicuous terms include headings in capitals of the same size or larger than the surrounding text or in contrasting type, font, or color to the surrounding text, and language that is in larger print than the surrounding text or in contrasting type, font, or color to the surrounding text or that is set off from the surrounding text by symbols or other marks that call attention to the language.
