Facts
Garrett (plaintiff) sued her employer, the University of Alabama (defendant), after it required her to take a lower paying position while she was undergoing treatment for cancer. Garrett’s suit for money damages was brought under Title I of the Americans with Disabilities Act of 1990 (ADA), which prohibits employers, including state governments, from discriminating against people with disabilities and requires employers to provide reasonable accommodations for disabled employees. The ADA permits suits for money damages to be brought against state government employers that violate these requirements. The legislative record accompanying the enactment of the ADA contained numerous examples of discrimination against people with disabilities by employers, including some discrimination by state and local governments.
