Bock v. Dalbey
Nebraska Supreme Court
815 N.W.2d 530 (2012)
- Written by Liz Nakamura, JD
Facts
Jennifer Lynn Dalbey (plaintiff) and Matthew John Bock (defendant) divorced in 2010. The parties filed a joint-income tax return in 2007 but did not file any tax returns for 2008 or 2009. Matthew earned substantially more than Jennifer. The district court directed Matthew and Jennifer to file joint-income tax returns for 2008 and 2009, and the court of appeals affirmed, stating that the order did not conflict with the parties’ right under the federal tax code to elect whether to file jointly or separately. Jennifer appealed.
