Arthur Frank Mayson worked at a secular, nonprofit gymnasium run by the Mormon church (the Church) (defendant). After being fired for failing to become a certified member of the Church, Mayson, along with other individuals representing a class (plaintiffs), brought suit based on Title VII of the Civil Rights Act of 1964, which prohibits discrimination in employment based on religion. Section 702 of the Act exempts religious organizations from this requirement. The district court held that applying the § 702 exemption to a religious organization’s secular nonprofit activities would violate the Establishment Clause of the First Amendment.
