Facts
On October 8, 1927, Abraham (defendant) sent a telegram to Courteen Seed Co. (Courteen) (plaintiff). The telegram stated that Abraham was “asking 23 cents per pound” for red clover seed. The telegram mentioned that he had an offer from a third party for 22 3/4 cents per pound. Courteen sent a telegram back stating that it accepted Abraham’s offer. Courteen later brought suit for breach of contract, alleging that the October 8, 1927 telegram constituted an offer. Abraham disputed that its telegram constituted an offer and moved for a nonsuit. The lower court denied Abraham’s motion.
