Facts
Two clerks of an A.G. Pollard Co. (Pollard) (defendant) store falsely accused George Economopoulos (plaintiff) of stealing a handkerchief from the store. They spoke the accusations out loud in the store—one clerk saying it in English and a second clerk saying it in Greek, which Economopoulos could understand. There was no evidence that anybody but Economopoulos heard the accusation in English and there was no evidence that anybody but Economopoulos understood the accusation in Greek. Economopoulos brought a suit for slander and the trial court found in favor of Pollard. Economopoulos appealed.
