Facts
Copley Pharmaceutical, Inc., (Copley) (defendant) filed a motion to decertify a nationwide products-liability class action that was brought against it in relation to the distribution of a contaminated bronchodilator—Albuterol—that Copley manufactured. Copley argued that because the action would require the court to apply multiple jurisdictions’ laws, the class action was unmanageable. Copley also cited a lack of precedent for any mass-tort case that required the application of the laws of all 50 states.
