Facts
Kewanee Oil Co. (Kewanee) (plaintiff) brought suit against Bicron Corp. (defendant) for misappropriation of trade secrets. The United States District Court for the Northern District of Ohio, applying Ohio trade secret law, found in favor of Kewanee and granted a permanent injunction against disclosure of Kewanee’s trade secrets. The United States Court of Appeals for the Sixth Circuit reversed, finding that the Ohio trade secret law was preempted by federal patent law. The United States Supreme Court granted certiorari.
