Facts

Carmen Masson (plaintiff) was hired in 1983 by the School Board of Dade County (school board) (defendant) as a culinary-arts teacher at Lindsey Hopkins Technical Education Center (school). From 1992 until 1997, the school principal, John Leyva, engaged in questionable behavior toward Masson, including commenting on her appearance, saying that he would “kiss her ass” for her good work, and kissing her on the face without consent. Rafael Urrutia served as the director for the school board’s Office of Equal Educational Employment Opportunity. In his position, Urrutia conducted workshops and training sessions for supervisors regarding harassment standards and disseminated information on the school board’s official harassment policies and complaint procedures. Masson filed no formal or informal complaints with Urrutia and did not utilize the official complaint procedures. Masson filed suit in federal district court, alleging a hostile work environment. The school board filed a motion for summary judgment.
