Facts

Neil Law and his wife Lucille Law (defendants) obtained an incorrect survey of their property. The survey stated that the Laws’ property was larger than it was. Relying on this survey, the Laws built a fence that enclosed a portion of a property belonging to John Meyer and his wife Leona Meyer (plaintiffs). The Laws maintained and cultivated this portion of land. The Meyers’ and the Laws’ titles each reflected the true boundary line, and they each paid taxes based on the true boundary line. The Laws claimed to have acquired title to the enclosed portion of land by adverse possession. The circuit court found in favor of the Laws. The district court of appeal affirmed. The Florida Supreme Court granted certiorari.
