Facts
A group of drunken men at a bar started a fight with Stachniewicz (plaintiff) and his friends. The men had been drinking at the bar for about two and a half hours when the fight was started. After the fight, Stachniewicz was found injured on the ground. Stachniewicz brought suit against the owners of the bar, Mar-Cam (defendant), claiming a violation of an Oregon regulation requiring bar owners to “prevent the recurrence of abuses associated with” bars. The trial court found in favor of Mar-Cam. Stachniewicz appealed.
