Taylor v. Town of Cabot
Vermont Supreme Court
178 A.3d 313 (2017)

- Written by Deanna Curl, JD
Facts
The town of Cabot (defendant) managed a grant program with federally derived funds that awarded grants to individual and organizations seeking to advance community goals. The United Church of Cabot, a historical building that operated as a place of worship and was used by secular community groups for events, applied for a $10,000 grant to fund a small portion of the cost of urgently needed building repairs. The people of the town voted to approve a grant that funded repairs to the steeple, a stairwell, and interior sections of the church at the town meeting. Taylor and another taxpayer (the taxpayers) (plaintiff) filed a lawsuit and sought a preliminary injunction, arguing that the use of any public funds for any repairs to the church violated the compelled-support clause of the Vermont Constitution.
