Facts
In 1996, Denise Lawrie began working as a shift manager at a residential facility run by Tri-County Youth Programs, Inc. (Tri-County) (plaintiff) for emotionally troubled adolescents. One day, Lawrie was sexually assaulted by one of Tri-County’s clients. The client was found guilty, placed on two years’ probation, and ordered to stay away from Lawrie. Tri-County agreed to allow the client to remain at the same residential facility where Lawrie worked, although Tri-County was not required to do so. Lawrie resigned because she was dissatisfied by how Tri-County had handled the sexual assault. Lawrie thereafter applied for unemployment benefits with the Division of Employment and Training (Division) (defendant). The Division denied Lawrie unemployment benefits. Lawrie appealed, and a board of review reversed. Tri-County appealed to the state trial court, which affirmed. Tri-County appealed.
