Princess Caroline (plaintiff) filed suit in Germany seeking an injunction that prohibited the continued publication of vacation photos of her and her husband. The German Federal Constitutional Court refused to issue an injunction because even though the photo itself was not of general interest, the content of the article accompanying the published photos did contribute to a debate of general interest. The article did not include any private details about Princess Caroline or her husband. The article only discussed the practical aspects of renting out the vacation property. Princess Caroline filed a complaint against Germany (defendant) in the European Court of Human Rights, challenging the German court’s refusal to issue an injunction as a violation of the European Convention on Human Rights.
