Facts
Susie Waube was looking out of the window of her house as her child crossed the highway. She witnessed a vehicle driven by Amber Rose Warrington (defendant) strike and kill the child, causing Mrs. Waube extreme shock and distress that led to her death. Subsequently, William Waube, as administrator of his wife's estate (plaintiff) brought suit against Warrington, Warrington's husband, and the Hardware Mutual Casualty Company (defendants) to recover for Mrs. Waube's death. The defendants filed a demurrer to the complaint, which was overruled by the trial court. The defendants appealed.
